The potential legal problems of educational institutions and public entities are many and varied and encompass the entire spectrum of civil law. In addition to attorneys who focus their practice on education law, the Firm also offers the multi-faceted experience of its entire legal staff and each of its lawyers.

The Firm represents educational institutions and public entities, and its attorneys have experience in the following areas:

  • Compliance with state and federal regulations, including but not limited to, Americans with Disabilities Act, Family Medical Leave Act (FMLA), Fair Labor Standards Act (FLSA), Title I of the Elementary and Secondary Education Act of 1965 regulations, No Child Left Behind, Title VII of the Civil Rights Act of 1964, as amended, Age Discrimination in Employment Act of 1967, as amended, Davis-Bacon Act, Family Educational Rights and Privacy Act (FERPA), and compliance with federal and state grant requirements
  • Advising on all aspects of purchasing and procurement, including competitive bidding statutes; advising clients regarding the intricacies of competitive bidding and other purchasing laws; drafting procurement documents, contracts with vendors, and advising clients concerning procurement disputes
  • Negotiating and drafting real estate and construction contracts; advising clients regarding requirements of acquisition and disposition of public property owned by educational entities, including leases, lease-purchases and other methods of acquisition and disposition
  • Advising on election law, including Voting Rights Act, and preparing Section 5 Preclearance Submissions to the Department of Justice
  • Representing school districts and public entities in employment disputes and matters, including grievances, terminations, and non-renewals of contracts, responding to EEOC charges, addressing leave issues, developing employee handbooks, addressing employee discipline matters, and conducting internal investigations of employee misconduct
  • Negotiating and drafting interlocal agreements between governmental entities, superintendents' contracts, and employment contracts
  • Broad experience in policy development, board governance, Texas Public Information Act, and Texas Open Meetings Act
  • Registering copyrights and trademarks, advising on intellectual property matters, and representing entities in intellectual property infringement disputes
  • Advising on student rights and discipline
  • Conducting numerous trainings for educational and governmental entities, addressing topics concerning contract terms and conditions, harassment, FERPA, use of force, reporting abuse and neglect, discipline and documentation, ethics, discrimination, board operating procedures and governance, school counselor issues, bullying and cyberbullying, internal investigations, reductions in force, and other topics
